Overview

Fasken provides comprehensive coverage for legal services on environmental assessment and permitting.  We work with project proponents to develop a permitting strategy and timelines; with consultants to develop quality application materials and support; and with Indigenous Groups and stakeholders to identify and address issues.  We represent proponents during regulatory proceedings and hearings, in settling permit conditions, and in protecting projects against legal challenges.

 

Whether your goals are to develop a power project or expand ongoing mining operations, you cannot begin without environmental review, up to and including full environmental assessment, and permits. Stakeholders must be confident that all the potential environmental risks have been identified and that you have a realistic plan to address those risks.

 

We act for clients undertaking a range of projects. We were counsel to TransCanada Pipeline during the approval process for its Prince Rupert Gas Pipeline and to BC Hydro in the environmental assessment of the multibillion-dollar Site C hydroelectric dam; both projects entailed substantial environmental investigation and review, Indigenous and community stakeholder consultation, permitting, and, ultimately, complex litigation.

 

We also represent foreign investors in cross-border transactions involving construction and modification of mining, wood treatment and chemical manufacturing operations.
